Student Loan with a private lending institution.

Posted on Thursday, November 30, 2006

I was recently discharged from bankruptcy in Alberta. Part of my accumulated debt were three student loans - 1 national, 1 provincial, and 1 (from 1999) with a private lending institution. On my discharge document the private loan looks as though it was disolved, such as a credit card debt, is this the case or do I still owe the bank the full amount?

You wouldn’t be able to determine this from looking at your discharge documents as any of the student loans, as long as they file the appropriate paperwork, are eligible to receive money in a bankruptcy. However this doesn’t mean that they are cleared. To determine this you must look at the legislation they were lending the money under, as you probably have no idea what guiding legislation was used you should check with your trustee.
