Exemptions?

Hello, I have 3 questions regarding exemptions:
1. I am leasing a car, owned by Chrysler and I am currently up to date with all the payments. The Car is worth an estimated $27,000 and I have about $24,000 owing on it. The lease is up June 2007. If I file for bankruptcy in Alberta can I still be able to keep this car and continue making payments?
2. I have roughly $3000 in an RESP for my daughter. As this is for my daughters education will it be affected ?
3. I understand I am able to have up to $4,000 in household furnishings and appliances. Does someone come into my home to access the value of everything?

Hello, I am a director of a smal corporation. I have locked into a lease that expires June 2011 and cann0t afford these payments as mycompany is not making any money. While this is the big debt, I have a variety of suppliers, my utilities, some taxes (gst and corporate tax) and a bank loan that I am considering bankruptcy. I see that you offer a a free, confidential assessment for personal situations, is this available when a business is involved? Where do I start? Am I cleared of the tax debt? How long is the process?

I claimed personal bankruptcy in Alberta in 2005. Because I had not met the Trustees Conditions I received a conditional order of discharge ( for payments to the trustees of about $1400).

In January 2006, I met these conditions, paid in full the amount owing, and received an Order of Discharge.

From a discussion I had with CRA they informed me that the Trustees had not dicharged. As a result my GST cheques are going to be sent to my trustee. Can the trustee legally still claim any GST cheques sent to them from the Government in relation to me just because they haven’t discharged themselves?.

I filed a bankruptcy and received an absolute discharged on June 4, 2004.

When I filed bankruptcy I had some shares in a private company, which were surrendered the trustee. The Shares are non transferable, had and had no value to the Estate and I believe that these shares are still in the custody of the Trustee. Can I re- claim or re-vest these shares in me, will Trustees cooperate in doing this? I would like to offer these share to the Company under company?s buyback scheme, the result is I may realize 15K in buyback. What are my options?

cost of bankruptcy

If a person has no income, and no way to borrow money how can they declare bankruptcy? I simply can’t afford the trustee’s fees. Is it necessary to go through a trustee?

student loans

I am a single mother of two. I have over 40k in student loans (both provincial and federal), have a car loan for approx. 10k. If I go bankrupt, will I be cleared of my student loans and will I be able to keep my car?

What is the difference between OPD and a consolidation loan?

Principle residence

I have recently been struggling with a long divorce, loss of a job and resulting depression. I do not have any assets except a 1/2 share of an apartment in Germany worth about CAN $30.000 (my ex-wife owns the other 1/2). I live in Alberta right now, although after filing for bankruptcy I plan on returning to Germany and living in the apartment. I understand that in Alberta you are allowed an exemption of up to $40,000 for a principle residence. Would that exemption apply to my situation? Thank you

I need to know if a company I have been dealing with has filed for bankruptcy. The company is located in Ontario, but I am in Alberta. I have tried to email the company to find this out, but no one responds to my messages. Where do I check this? Thx
