My mother was travelling in the US when she got ill. For whatever reason her insurance would not cover her. She is 72 years old, doesn�t own any assets. Is she eligible to claim bankruptcy?
This is an interesting issue. First, you mother is eligible to file a bankruptcy in Canada. However, the interesting part relates to debts that would have been occurred oversees. These are something that you will need to discuss with a trustee prior to filing the bankruptcy. I can provide a quick overview, essentially any non-Canadian debts are not cleared, but the creditors will loose the right to collect from you mother while she is in Canada. As a result, the only time this could cause her any difficulties is if she returned to the country where she owes these debts.
