My mother was travelling in the US when she got ill. For whatever reason her insurance would not cover her. She is 72 years old, doesn?t own any assets. Is she eligible to claim bankruptcy?

This is an interesting issue. First, you mother is eligible to file a bankruptcy in Canada. However, the interesting part relates to debts that would have been occurred oversees. These are something that you will need to discuss with a trustee prior to filing the bankruptcy. I can provide a quick overview, essentially any non-Canadian debts are not cleared, but the creditors will loose the right to collect from you mother while she is in Canada. As a result, the only time this could cause her any difficulties is if she returned to the country where she owes these debts.
