If my husband and I both declare bankruptcy, do we both get the exemptions (ie: one car each)?

    If you file separate bankruptcies you would receive separate exemptions, but if you file jointly then you only have access to 1 set of exemptions (although the fee to file would be less).

    For a more detailed explanation of why this is you are best to contact a licensed trustee and they will be able to help you determine if your file would need to be filed jointly or separtely.
