Fraud

Posted on Monday, January 01, 2007

Hello, is it considered fraud if I receive money from my previous employer ($12,200.00) just before I file for bankruptcy in Canada and then use it to pay for a training course just before i file? Will i have to pay this money back? Will it cause me difficulties while I am in a bankruptcy?

While I am in no position to make a valid judgment on this issue, it is very likely this would be considered an offense under the Bankruptcy and Insolvency Act and for you to be eligible for a discharge from bankruptcy at a minimum I anticipate that you would be required provide the full value of monies used to the bankruptcy estate (i.e. the trustee).
