RRSP funds cashed in prior to bankrutpcy

Posted on Thursday, January 11, 2007

I need clarification. I live in Alberta and recently cashed in an RRSP. I used these RRSP funds to buy a car as my other one died. Unfortunately some things have changed I now have to declare bankruptcy. Will this cause me any difficulties?

This is an issue you must discuss with a licensed trustee. The trustee will have to review many of the specific factors in your situation to determine if this will cause you difficulties, but be aware that it is possible. There is a potential that this will be viewed as converting a non-exempt asset into an exempt asset in an attempt to thwart your creditors and how much of a risk this is requires more detail.
