If my husband files for bankruptcy what happens to our home? It is in my name right now but at the time he took out this business loan we were living in a different house that was in both our names, could they make us sell our current home to pay out the bank?

    In Alberta we are bound by the Dower Act. Essentially this says that it makes no difference whose name the house is in, if you both live their and both contribute to the benefit of the household the asset belongs to the both of you. While it is difficult to say what the creditors will do, technically speaking as a result of these Dower Rights you may have some issues that could impact the property.
