Can I file without husband or an income?

I have about 30K in credit card debt. I have zero income right now as I just finished maternity leave and have a second child due in 2 weeks. (the 2nd was not planned or expected) My husbands income barely covers necessities never mind minimum payments. Can I claim bankruptcy without him? How would payments be worked out if I can\'t work? (due to being pregnant and a mental condition) We tried for a consolidation loan but we were denied. Is bankruptcy an option?

    When you file for bankruptcy you are required to disclose the income of everyone in the household. However, in your situaiton if you have no income coming in it will really make no difference (as there is a surplus income calculation tha tmust be done, but it is tied to your percentage of the household income which is likely zero so therefor you do not need to worry about surplus).


    As a result you will qualify for the minimum cost of a bankruptcy, which typically works out to somewhere between $1600 to $1800 dollars. The best thing to do is to contact a local trustee and they will be able to explain this in more detail.
