Alberta former residency/now Ontario resident

I am a former resident of Alberta and have gone through an ugly divorce. I am facing some legal battles in Alberta. The matrimonial home is still in our joint names. I no longer live in Alberta and haven\’t for 2 years. I now live in Ontario and am re-married. If I claim bankruptcy in Alberta will it get me out from these legal claims? How will it affect what is happening in ONtario? Do I have to claim bankruptcy here in Ontario as well? Thank you.

  1. Barton Goth, CIRP, Trustee in Bankruptcy says:

The bankruptcy legislation is federal legislation so regardlesss whether you file in Ontario or Alberta the effect will be the same.

In terms of where you should file, you need to file where you reside, so if you are currently living in Ontariou you should file there.
